Forrest Law will sponsor the ABAC meeting on November 15th!

We will be sponsoring the ABAC meeting in November and will continue to work with all auto body shops to ensure that your customers get the value for their car that they deserve.  There will be a brief explanation of the DV process as well as time for questions and answers.  We may even have time to discuss labor rate issues that seem to be pervasive throughout the industry.  As you can see from the recently settled cases below, Forrest Law continues to successfully use Connecticut’s diminished value law. Please keep us in mind for future customers who might be interested in our services.

LEGAL NOTE

Caporale Jr. v. Aubertin

August 22, 2011

Successful Connecticut Diminished Value Case

“Plaintiff Caporale sues for the diminution in value of his automobile…Plaintiff’s expert witness, Mr. Collins, testified that the value of the automobile was diminished by over $5,350 because the frame was bent. He valued the pre-loss value at   $25,157 and the post repair adjusted value at $19,807.

“The Defendant concedes liability.  Connecticut case law holds that the negligent party is responsible for the diminished value of the vehicle.  The Plaintiff’s expert witness was credible in his evaluation.

“Judgment [is] for the Plaintiff in the amount of $5,000 plus costs….”

Barbara L.S. Schadt, Magistrate
