Successful Connecticut Diminished Value Case
“Plaintiff Caporale sues for the diminution in value of his automobile…Plaintiff’s expert witness, Mr. Collins, testified that the value of the automobile was diminished by over $5,350 because the frame was bent. He valued the pre-loss value at $25,157 and the post repair adjusted value at $19,807.
“The Defendant concedes liability. Connecticut case law holds that the negligent party is responsible for the diminished value of the vehicle. The Plaintiff’s expert witness was credible in his evaluation.
“Judgment [is] for the Plaintiff in the amount of $5,000 plus costs….”
